Any disputes must first be submitted to IBPet for internal review. If unresolved, disputes shall be resolved exclusively through binding arbitration under the rules of the American Arbitration Association (“AAA”).
No class actions or class-wide arbitrations are permitted.

You waive your right to participate in class or representative actions.

15. MODIFICATIONS TO THE SERVICES & TERMS

IBPet may, at any time and without notice:

  • Modify or discontinue any part of the Services

This Return & Refund Policy (“Policy”) governs all returns, replacements, refunds, and related consumer rights for purchases made through IBPet.com and its associated digital properties (collectively, the “Services”). 5. Exchanges

Exchanges are only available for:

  • Defective items
  • Incorrect items shipped by IBPet

Exchanges are not offered for preference-based reasons such as size, color, or style.

If a replacement is unavailable, IBPet may issue a refund in its sole discretion.

6. Defective, Damaged, or Incorrect Items

Lost, Damaged, or Missing Shipments

Backorders

If an item cannot be fulfilled due to lack of inventory, the available items within the order will be shipped immediately. IBPet does not reserve or hold backordered items for future fulfillment.

8. False Claims Warning

10. No Warranty Regarding User-Generated Content

IBPet does not warrant, guarantee, or verify the accuracy, ownership, authorship, legality, or non-infringing nature of any user-generated content, supplier-submitted content, third-party uploads, or materials provided by external partners (“Third-Party Content”).

All Third-Party Content is provided “as is,” without any representation or warranty of any kind, express or implied.

IBPet is not responsible for:

  • incomplete or inaccurate claims by uploaders
  • mislabeled or mislentified works
  • counterfeit or pirated submissions by third parties
  • any unauthorized use of copyrighted materials by users or suppliers

Users bear sole responsibility for the content they upload, transmit, or share through the Services.

11. Limitation of Liability

To the maximum extent permitted by applicable law, IBPet, its officers, directors, employees, agents, affiliates, and licensors shall not be liable for any claims, damages, losses, liabilities, costs, or expenses arising from or relating to:

  • user-generated content
  • supplier content or listings
  • DMCA notices or counter-notices
  • removal or restoration of content
  • inaccurate or fraudulent DMCA submissions
  • interruptions in service due to DMCA removals
  • any actions taken in compliance with the DMCA

Under no circumstances shall IBPet be liable for:

  • indirect damages
  • incidental damages
  • punitive damages
  • consequential damages
  • loss of profits
  • loss of data
  • reputational harm

even if IBPet has been advised of the possibility of such damages.

This Limitation of Liability is intended to be interpreted broadly and applies to all legal theories, including tort, contract, statutory claims, or otherwise.

12. Indemnification

Users agree to indemnify, defend, and hold harmless IBPet and its affiliates, officers, employees, agents, contractors, successors, and assigns from and against any and all claims, demands, actions, losses, liabilities, damages, judgments, settlements, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:

  • any content uploaded, posted, or transmitted by the user
  • any allegation that user content infringes upon a third party’s copyright, trademark, or other intellectual property rights
  • any misuse of IBPet’s Services
  • any fraudulent or improper DMCA notice or counter-notice
  • violation of applicable laws related to user-submitted content

Users agree this indemnity survives:

  • account termination
  • removal of content
  • policy updates
  • discontinuation of Services

This clause fully transfers legal and financial risk to the user.

13. Governing Law & Venue for DMCA-Related Disputes

Any dispute, claim, or controversy arising out of or relating to DMCA notices, counter-notices, copyright claims, or the removal or restoration of content shall be governed by and construed in accordance with the:

  • laws of the State of Wyoming (or your state of formation)
  • federal laws of the United States

without regard to conflict-of-law principles.

Venue for any litigation shall lie exclusively in the federal or state courts located in:
